1. Acceptance of Terms

By accessing or using AYTADA ("the Service"), operated by AYTADA ("we", "us", or "our"), you agree to be bound by these Terms & Conditions. If you do not agree, you may not use the Service.

2. Description of Service

AYTADA is an AI-powered platform that generates video advertisements from product information. The Service uses artificial intelligence models to create scripts, scenes, video clips, voiceovers, and final stitched ad videos. Output quality depends on input quality and the AI models used.

3. Account Registration

You must create an account to use the Service. You agree to provide accurate information, maintain the security of your credentials, and accept responsibility for all activity under your account. You must be at least 18 years old to use the Service.

4. Credits & Payments

• New accounts can explore the full ad creation wizard at no cost. Credits are required to generate video content, voiceover, and final stitching.
• Additional credits can be purchased via PayPal (USD). All purchases are final and non-refundable except where required by law.
• Credits are consumed when generating scripts, scenes, videos, voiceovers, and stitched outputs. Costs vary by quality tier and ad length.
• Credits do not expire but are non-transferable between accounts.
• We reserve the right to modify credit pricing with reasonable notice.

5. Acceptable Use

You agree not to:

• Use the Service to generate content that is illegal, harmful, defamatory, or infringes on third-party rights.
• Upload images or content you do not have the right to use.
• Attempt to reverse-engineer, exploit, or circumvent any technical limitations of the Service.
• Use automated tools to access the Service beyond normal usage patterns.
• Resell or redistribute generated content as a competing AI generation service.

6. Intellectual Property

• You retain ownership of content you upload (product images, descriptions).
• You are granted a non-exclusive, worldwide license to use AI-generated outputs for commercial advertising purposes.
• The AYTADA brand, logo, and platform code remain our intellectual property.
• AI-generated content may not be unique — similar inputs may produce similar outputs for different users.

7. AI-Generated Content Disclaimer

Content generated by the Service is produced by artificial intelligence models. We do not guarantee that generated content is accurate, appropriate, or free from errors. You are solely responsible for reviewing and approving all generated content before use in advertising or any other purpose.

8. Limitation of Liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service depends on third-party AI providers and infrastructure. We may perform maintenance, updates, or modifications that temporarily affect availability. Credits will not be refunded for temporary service interruptions.

10. Termination

We may suspend or terminate your account if you violate these terms. You may delete your account at any time. Upon termination, unused credits are forfeited. Sections that by their nature should survive termination will remain in effect.

11. Changes to Terms

We may update these terms at any time. Material changes will be communicated via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the updated terms.

12. Governing Law

These terms are governed by the laws of South Africa. Any disputes shall be resolved in the courts of South Africa.
